This privacy policy applies to all personal data processed by Openbare-Verkopen.be BV, with registered office at Belgium, 8540 Deerlijk, Fabrieksstraat 5, with company registration number BE0812.312.345 which is the controller of this website.
The process controller spends high importance to your privacy and therefore processes your personal data in accordance with European Regulation 2016/679 of April 27th, 2016, on the protection of natural persons regarding the processing of personal data (hereafter “GDPR”) as well as any future or additional legislation implementing it, where applicable.

“Processing personal data”, what does it mean?
The processing of personal data (hereafter “data”) involves any kind of processing data which can identify you as a natural person. You can read in our Privacy policy, which data it includes.
The meaning of ‘processing’ is very wide and covers actions like collecting, saving, using your data, or sharing it to third parties.
What data do we process?
Below you’ll find a list of possible data that we could process. Depending on the situation, your preferences and the way you are contacting us, we will not process all data listed below.
Client data
From our customers, we process in the importance of our core business, which is the use of our platform online-auctions.be, openbare-verkopen.be and the activities of stockstunter.be, the following personal data:

- General contact data (e-mail, address, phone number, …);
- Contractual data (ex. address, VAT-number, agreement, offers, etc.);
- Payment and invoice data (bank account, invoice address, …);
- After-sales service;
- Testimonials, questionnaires, promotional content like pictures, videos on social media (ex. evaluations and experiences related to our services, posts on social media through our accounts on LinkedIn, YouTube, X, Instagram and Facebook)(list is not limited)

In context of collaboration with our suppliers, service providers and partners, we will process following personal data:

- General contact data (e-mail, address, phone number, …);
- Company related data for as far that it is possible to identify a natural person based on that data
- Contractual data (ex. address, VAT-number, agreement, offers, etc.);

- Feedback, testimonials, quotes, promotional content (ex. evaluations and experiences related to our services, presence on events etc.)
Candidate employers
Possible data that could be processed, related to candidate employers, is listed below. This depends on your own input that you are willing to share with us, in accordance with the open vacancy:
- General identification data (name, surname, login, …);
- General contact data (e-mail, address, phone number, …);
- Resume, recommendations.
- Personal specialties;
- Work related data;
- Personal data, tests, interviews;
- Pictures or videos provided by the candidate employer.
Website visitors
Of all visitors to our websites www.openbare-verkopen.be, www.auctions-online.be and www.stockstunter.be , we will process following data:
- IP-address, browser type, location data, how the individual found our website, interests and the way the individual navigates through our web page (through strictly necessary analytical and marketing cookies)
- Naam, surname, e-mail address, contact message (through the online contact form);

Following data will be processed related to marketing activities:

For what purposes do we process your data?
Personal data is exclusively processed within the framework of the company, more specific for following purposes:
- Offering of our services,
- Management of our online platforms openbare-verkopen.be, auctions-online.be and stockstunter.be;
- Marketing purposes like retargeting (we only obtain data exclusively from our website);
- Comply with administrational, legal and fiscal obligations;
- Communication with customers, prospects and partners;

We process your data for the purposes below. We only collect and process these kinds of data, no others than those necessary to obtain these goals.

Necessary for performance of agreement
Certain data are processed by us, because it is necessary for entering, executing, or terminating an agreement with you or the person involved. For example, to contact, schedule, react to a request or request for information in the context a contractual relationship, but also the actual performance of the contractual assignment in the context of our core business, in order to offer you our services or receiving your services.
Legitimate interest
Certain data are processed by us, based on the legitimate interest which in specific cases outweighs any potential disadvantage to your rights. For example sending a newsletter to our existing clients, improving the quality of our services, educating our employees; evaluating and maintaining your data and statistics involving our activities, in a broad sense; saving and using evidence in the context of liability, procedures or disputes and for archiving purposes of the activities; and guaranteeing safety, online on these websites as offline in our headquarters.

Certain data are processed by us, based on your permission. For example, for sending our newsletter to non-customers; the use of certain analytic or marketing cookies; publishing pictures that contain personal data onto our website and social media channels. Data of applicants after the recruitment process will be saved when having permission.
Origin of data
Most of the data we process, has been granted directly by you. Within the context of our services, it is possible that we receive data from you through external service providers or public sources.
With whom do we share your data with?
We do not share your data with other parties, unless it is strictly necessary in the context of purposes listed above, or if we are legally obliged to do so.
If necessary, we appeal to external service providers (processors), to support our operational goals like the maintenance of our websites and IT-systems. These external service providers execute certain actions and data on behalf of us. We will only share your data with these external service providers when necessary for the actions we need or demand from them. These data can’t be used by them for other purposes. On top of this, these external service providers are legally bounded to treat your data confidentially and secure these data, by a “processing agreement”, signed by both parties.
In concrete terms, this results that we share your data, for as far relevant to your situation, with third parties listed below, with following purposes, where these third parties in some cases act as processors on behalf of us:
- Post companies, transportation companies and delivery companies, if we need to send something by mail to you;
- Payment providers if we need to transfer payments to you or receive payments by you;
- External representatives or consultants or any other parties in the context of our core and side businesses.

How long do we save your data?
We do not save your data longer than necessary, for the purpose the data has been collected and processed for. Since the period for which data may be retained depends on the purposes for which the data was collected, the storage period may vary in each situation. In some cases, specific legislation will oblige us to store data for a certain amount of time. Our storage timeframes our always based on legal requirements and a consideration of your rights and expectations with what is useful and necessary for fulfilling the purposes. When the storage timeframe expires, your data will be erased or anonymized.
Where do we store your data and how is it being protected?
We provide fitting safety measures on technical and organizational level. We do this in order to operate within the context of our activities, to avoid destruction, loss, falsification, change, unauthorized access or unlawful notification to third parties, or any other not permitted process of these data.
In addition, we pay attention to make sure that those we assign to process data, are also applying the same safety measures, in order to reduce risks of incidents as much as possible.
If your data is processed, when using specific services or software tools, outside the European Economic Area (EEA), then this will exclusively happen in/to countries of which the European Commission has approved that they guarantee a fitting protection level of your data, or guarantee that measures will be taken to assure that the processing of your data is done in a rightful manner in these third countries.

Right of access and copy
You have the right to look into your data and receiving a copy. Within this legal area, you also have the possibility to request further insights regarding the processing of your data, for example the categories of your data being processed and for what goals this happens.
Right for adjustment or rectification
You have the right to adjust your data, when you claim that the data we have is not correct.
Right to exchange data (right of oblivion)
You have the right to demand that we erase your data, without any unreasonable delay. Nevertheless, we are not always able to do this, for example when your data is needed in function of a current agreement, or when saving your data is legally obliged for a certain amount of time.
Right to restrict processing
You have the right to restrict the processing of your data. By demanding this, the processing of your data will be stopped temporarily, until for example the justification of it is assured.
Right to withdrawal your permission
When the processing of data is based on your permission, then you have the right to withdraw this permission at any moment by contacting us. For marketing messages sent by us through email, based on your permission, you can easily withdraw your permission by clicking on the unsubscribe link provided in the message sent.
Right to object
You have the right to object the processing of your data which is based on legitimate interest. This needs to be done based on specific reasons towards your situation. There is also a possibility to object the use of your data towards direct marketing. Marketing messages sent by email will always be provided with an opt-out option.

How can you exercise your rights?
You can exercise your rights by contacting us, by email privacy@openbare-verkopen.be or mail to Fabrieksstraat 5, 8540 Deerlijk, provided with a copy of the frontside of your identity card or other document that identifies yourself. The copy will only be used for identification according to GDPR.
Changes
We reserve ourselves the right to change this Privacy policy. The most recent version will always be available on our websites. The date on which the Privacy policy has been changed for the last time, can be found on top. In case of substantial changes of the Privacy policy, we will inform the person concerned (to who this might have an impact), directly if possible.
